Please read these Terms of Service carefully before using the Maakan platform. These Terms govern your access to and use of our rent management services.

1. Acceptance of Terms

  • By accessing or using the Maakan platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use the Service.
  • These Terms apply to all visitors, tenants, landlords, and property managers who access the platform.
  • We may update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the revised Terms.

2. Use of the Service

  • You must be at least 18 years of age to use this Service.
  • You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
  • You agree not to use the Service for any unlawful purpose or in any way that could harm Maakan, its users, or third parties.
  • You must not attempt to gain unauthorised access to any part of the platform or its infrastructure.

3. User Accounts

  • When you create an account, you must provide accurate and complete information.
  • You are responsible for keeping your account information up to date.
  • Maakan reserves the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.
  • You may not create multiple accounts or transfer your account to another person.

4. Property Listings and Content

  • Landlords and property managers are responsible for the accuracy and completeness of property listings and related information.
  • All listings must comply with applicable laws, including fair housing regulations.
  • Maakan does not verify the accuracy of property listings and accepts no liability for inaccuracies.
  • We reserve the right to remove any listing that violates our policies or applicable law.

5. Payments and Fees

  • Rent payments processed through Maakan are subject to our payment processing terms.
  • Maakan may charge service fees to landlords or tenants; these will be disclosed prior to any transaction.
  • All fees are non-refundable unless explicitly stated otherwise.
  • In the event of payment disputes, both parties should first attempt to resolve the issue directly before contacting Maakan support.

6. Intellectual Property

  • The Maakan platform, including its design, software, logos, and content, is the intellectual property of Maakan.
  • You may not reproduce, distribute, or create derivative works from any part of the platform without our written permission.
  • By uploading content (e.g., property images, documents), you grant Maakan a non-exclusive licence to use that content to provide the Service.

7. Limitation of Liability

  • The Service is provided "as is" without warranties of any kind, express or implied.
  • Maakan shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
  • Our total liability to you for any claim arising from the use of the Service shall not exceed the fees paid by you in the six months preceding the claim.
  • We do not guarantee uninterrupted or error-free service.

8. Governing Law

  • These Terms are governed by the laws of India.
  • Any disputes arising from these Terms or the use of the Service shall be subject to the exclusive jurisdiction of the courts in Kolkata, West Bengal, India.
  • If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force.
